Asbestos-Contaminated Talc Central to Old Spice Mesothelioma Lawsuit.

Willie McNeal Jr., a Vietnam War veteran and retired school bus driver, was awarded $4.8 million by a California Superior Court jury that determined asbestos-contaminated talc led to his diagnosis of malignant pleural mesothelioma.

Whittaker, Clark & Daniels, a longtime talc supplier now based in South Plainfield, New Jersey, was ordered to pay McNeal $1.8 million in compensatory damages and $3 million in punitive damages.

The verdict stemmed from evidence presented that an Old Spice powder product, used almost daily by McNeal for more than 20 years, contained talc from a mine in North Carolina known to be contaminated by toxic asbestos, a naturally occurring mineral that can cause mesothelioma cancer.

Old Spice is a registered trademark of Procter & Gamble, which discontinued the powder product many years ago.

McNeal, 78, was diagnosed in 2017, a year before his case was filed against more than a dozen defendants.

According to court records, Johnson & Johnson, R.J. Reynolds Tobacco Company, Pep Boys and AutoZone Inc. also were named as contributors to his cancer diagnosis. All but Whittaker, Clark & Daniels settled before the trial began in April.

Whittaker, Clark & Daniels has been a major talc supplier for several companies, including Revlon, Avon and Chanel.

The talc company settled a similar case recently with a California woman who said her mesothelioma was caused by contaminated talc. The undisclosed settlement came four days after proceedings began at the same California Superior Court, and only a week after McNeal’s trial had concluded.

Nonoccupational Asbestos Exposure Growing.

Whittaker, Clark & Daniels continues to insist that its talc is safe and does not cause cancer, but it has been battling the accusations by mesothelioma patients since 2015.

The first case against the company involved a New York woman who was awarded $7 million when it was ruled that asbestos-contaminated talc in Desert Flower powder led to her mesothelioma.

In 2016, the talc used in a barber shop resulted in a record-setting $18 million verdict against Whittaker, Clark & Daniels after the son of a barber there was diagnosed with mesothelioma.

Although the majority of contaminated talc cases involve ovarian cancer, the number of mesothelioma cases has grown significantly in the past few years.

According to KCIC, a well-respected consulting firm that manages asbestos product liabilities, there has been a steady decline in traditional mesothelioma lawsuits stemming from occupational exposure to asbestos in the past three years. However, there also has been a rise in cases involving talc and nonoccupational exposure to asbestos during the same time period.

Nonoccupational exposure cases have gone from 33% to 45% for men and from 46% to 57% for women.

The issue of contaminated talc, considered the world’s softest mineral, stems from where it is mined near the Earth’s surface. Talc and asbestos deposits often are found in close proximity.

Talc Litigation Becoming More Common.

The regularity of mesothelioma lawsuits involving talc is expected to continue increasing in the coming months throughout the country, particularly where the COVID-19 pandemic had created a major backlog of civil litigation.

Another talc jury trial involving cosmetic talc and mesothelioma opened May 5, one of the first in Washington state since the COVID-19 pandemic shutdown a year ago. In the opening statements, attorneys for the plaintiff blamed the use of Johnson’s Baby Powder for the mesothelioma cancer.

Johnson & Johnson has said it is facing more than 25,000 lawsuits related to its various talc products that have allegedly caused cancers, primarily due to asbestos contamination.

According to regulatory filings with the U.S. Securities and Exchange Commission, Johnson & Johnson has set aside almost $4 billion for talc-related litigation.

Sarcomatoid mesothelioma has the least favorable prognosis compared to the other common cell types. Studies have shown life expectancies ranging from one month to about 28 months. The majority of patients face a median survival of six months or less.

An individual’s prognosis will also depend on the type of mesothelioma and stage at diagnosis, as well as the patient’s age, gender and overall health.

Patients with biphasic mesothelioma may face a worse prognosis if sarcomatoid cells are more dominant than epithelioid. Biphasic mesothelioma patients typically have a life expectancy of about one year. However, if sarcomatoid cells make up more than 10% of the tumor, patients may have more limited treatment options and a worse prognosis.

Treatment - Sarcomatoid Mesothelioma Treatment.

Research shows sarcomatoid mesothelioma is the most difficult to treat of all cell types. Studies suggest the cells are resistant to many standard therapies. Because malignant sarcomatoid mesothelioma spreads quickly throughout the body, surgery may not be a viable option for many patients.

Chemotherapy is often a first-line treatment for sarcomatoid mesothelioma. Though some studies show the cells can be resistant to chemotherapy, research suggests the treatment may extend survival in some cases.

One study examined 137 pleural sarcomatoid mesothelioma patients between 2000 and 2014. Researchers found:

19 patients had a positive response to chemotherapy treatment, meaning disease progression slowed or stopped during treatment.
Patients with positive responses received chemotherapy as a first-line treatment.
Sarcomatoid patients experienced a 13.9% response rate compared to a 21.9% response rate across all types of mesothelioma.

Immunotherapy treatments have also shown promise in clinical trials for sarcomatoid mesothelioma. Early research suggests it may be an effective option for patients with sarcomatoid mesothelioma who previously received chemotherapy. Some early evidence indicates sarcomatoid mesothelioma may be more responsive to immunotherapy than other cell types.

Radiation therapy may also be applied in some cases. It is often used as a palliative treatment to lessen symptoms and improve a patient’s quality of life.

Research continues to investigate possible treatment combinations to improve life expectancy for sarcomatoid mesothelioma patients.

Shipyard workers had to cut, shape, saw and sand asbestos-containing materials during installation and repair work, which created a lot of asbestos dust. Dust was also an issue during decommissioning because it required workers to demolish asbestos-containing materials.

Civilians and veterans who worked in shipyards also reported many cases of mesothelioma.

Mesothelioma is an aggressive cancer that attacks the mesothelium, which is a thin membrane made of epithelial cells that lines all of the body’s organs as well as body spaces like the thoracic cavity and abdominal cavity.

Mesothelioma most often develops in the lining of the lungs and pleural cavity, and is well known for its association with the carcinogen asbestos.

In fact, the late Hollywood actor Steve McQueen is well-known for having developed mesothelioma after years of asbestos exposure while in the military.

The vast majority of mesothelioma cases stem from asbestos exposure.

Asbestos is a mineral that was widely used as construction material in everything from paint to insulation to roofing tiles because it has strong fibers that were resistant to fire and served as good insulation.

Asbestos fibers are jagged in shape, and extremely tiny - about 500 times finer than a human hair.

If those tiny asbestos fibers get inhaled over time, they make their way into the interstitial space of the lungs and then slowly make their way over to the epithelial cells of the visceral or parietal pleura - both of which are layers of mesothelium.

The microscopic, jagged asbestos fibers are so small that they can get tangled up with the cell’s chromosomes.

At that point, they can damage the DNA causing a variety of mutations, which ultimately allow those epithelial cells to divide uncontrollably, turning into a tumor.

Over time, small cancerous growths called mesothelial plaques start to cover the visceral pleura over the lungs and the parietal pleural under the chest wall.

Interestingly, these growths start to express a lot of calretinin, a calcium-binding protein, involved in regulating calcium levels within the cell - this is something that helps to distinguish mesotheliomas from other types of tumors.

In addition to affecting the lungs and pleural lining, asbestos fibers can also end up in the stomach if saliva containing the material or mucus from the airways is swallowed.

It is estimated that about 3,000 people are diagnosed with mesothelioma each year in the United States. Mesothelioma occurs more often in men. It is also more common in white and Hispanic people than in Asian American or African American people. The average age for a pleural mesothelioma diagnosis is 72. The number of people diagnosed with mesothelioma in the United States is no longer increasing as it has been in previous decades, and it is now decreasing slightly in men.

The 5-year survival rate tells you what percent of people live at least 5 years after the cancer is found. Percent means how many out of 100. The overall 5-year survival rate for people with mesothelioma is 10% because it is usually diagnosed at a late stage.

If the cancer is found at an early, localized stage, the 5-year survival rate for people with mesothelioma is 18%. If the cancer has spread to nearby areas and/or lymph nodes, the 5-year survival rate is 12%. If the cancer has spread to distant parts of the body, the 5-year survival rate is 7%.

The length of time a person lives after being diagnosed with mesothelioma depends on many factors, including the person’s age. People diagnosed at a younger age often live longer. The type of mesothelioma can also influence survival rates. In particular, some people with peritoneal mesothelioma have a tumor that grows very slowly. People with peritoneal mesothelioma often live longer. People who are able to receive surgery generally live longer than people whose cancer has spread too far to be surgically removed.

It is important to remember that statistics on the survival rates for people with mesothelioma are an estimate. The estimate comes from annual data based on the number of people with this cancer in the United States. Also, experts measure the survival statistics every 5 years.
