The Prudential Insurance Company of America is a global company, has been in the insurance business for over 135 years. Prudential is the second largest group life insurance company in the US and a leading carrier of Short Term and Long Term Disability Insurance.
The Long Term Disability Policy often takes over where the Short Term Policy ends, replacing part of the policyholders salary if they become disabled and are unable to work. The employer may pay for part of the policy or they may share the cost with the employee. Because these policies are Group Policies, lawsuits filed to appeal Prudential's claims denials are filed under the Employee Retirement Insurance Security Act (ERISA). If Prudential has unfairly denied your claim or stopped your benefit they are aware, if the courts overturns their decision and make them pay there is no punishments for them under ERISA statutes. Prudential will then, only have to pay the claimant what they would have originally owed them in the first place.
Many cases against Prudential recently claiming the denial of claims were unfair, unjust, and unreasonable.
Ex: A policy holder approved to receive Long Term Disability payments. But after 24 month Prudential reviewed their eligibility and determined the claimant no longer satisfied to the definition of disability under the language. Even though the claimant was found disabled under the Social Security Administration using the same information presented to Prudential.
